JUAN RAMON LOZANO, S.A.U through these General Terms and Conditions of Purchase offers its users and visitors the possibility of making online purchases of the products and services offered, as well as establishing communication with the user.
JUAN RAMON LOZANO, S.A.U will develop its e-commerce activity as a virtual store through the website http://www.bodegas-lozano.com/.
JUAN RAMON LOZANO, S.A.U may alter at any time and without prior notice, the design, presentation, and/or configuration of the Website, as well as some or all of the services.
1.3.- Acceptance of the particular conditions of purchase.
Access to and use of the service at http://www.bodegas-lozano.com/ implies on the part of the User the full and unreserved acceptance of all the conditions set forth in these General Terms and Conditions of Purchase. Likewise, JUAN RAMON LOZANO, S.A.U reserves in any case the unilateral right to modify these General Terms and Conditions.
Any order placed with JUAN RAMON LOZANO, S.A.U necessarily implies, as an essential, determining, and indispensable condition, the unreserved acceptance by the customer of the General Terms and Conditions of Purchase of its products, in force on the day the corresponding order is placed. Furthermore, the customer acknowledges that acceptance of these General Terms and Conditions of Purchase will imply their application to the order to which they refer, as well as to any subsequent order, except in those cases where new conditions are brought to their attention by JUAN RAMON LOZANO, S.A.U.

2.4. Product availability.

When we click on the process order button (after having selected the products and quantities), the registered user must enter their username and password data, accessing directly to a personalized purchase panel, where they can modify their shipping address data and select the different types of shipping and payment methods; in the case of purchase as a guest, personal data will be requested for order processing and delivery.
2.6.- Prices.
The prices applicable to each product, which include VAT, are those indicated on the product sheet. During the purchase process, the amount corresponding to the tax charge according to the current rate at any given time and applicable to the products and/or services marketed will appear itemized, as well as the corresponding shipping costs itemized before order confirmation.
Offers will be duly marked and identified as such, appropriately indicating the previous price and the offer price.
JUAN RAMON LOZANO, S.A.U reserves the right to make, at any time and without prior notice, any modifications it deems appropriate, and may update products and services daily according to the market.
The corresponding shipping costs are always indicated in the order.
For shipments made to countries not belonging to the European Union, JUAN RAMON LOZANO, S.A.U will not assume the costs corresponding to taxes and customs duties specific to each country.
In the event of a price variation, JUAN RAMON LOZANO, S.A.U will communicate the variation to the customer by email and the customer may choose to cancel their order without any additional cost being charged.
2.7.- Payment methods.
JUAN RAMON LOZANO, S.A.U offers various payment methods so that the customer can choose the one that is most convenient or best suits their needs:
If this is the method selected by the user for payment, a secure connection is established, through SSL[1], where you must confirm payment and enter banking details directly. Delivery times begin to count from this date. To process the order as soon as possible, it is necessary that the order number appears in the transfer reference. The Company will not be responsible for delays caused by this reason.
To make the disbursement through this form of payment there are two options to choose from:
· Albeso, whereby the order will arrive within 24/48 hours. The transport service will bring the shipment to the address provided, and you will pay the amount to the delivery person there. For this it will be essential that you provide us with your contact telephone number. Shipping costs through this option (up to 10 kg weight) will be €7.94.
Specific conditions for this payment system. If the cash on delivery payment method is chosen, in addition to the product price, the surcharge stated above of €7.94 must be paid, as a transport tax.
2.8.- Non-payment.
Upon the agreed maturity date for shipment, in case of total or partial non-payment by the customer, JUAN RAMON LOZANO, S.A.U may suspend or cancel any shipment, without incurring liability for any damages or losses, including loss of profit, or damages for delay or loss of production caused to the customer. The aforementioned power of JUAN RAMON LOZANO, S.A.U shall in no case release the customer from their contractual obligations regarding payments owed and receipt of products.
2.9.- Invoicing.
JUAN RAMON LOZANO, S.A.U will be obliged to issue an invoice to those customers who request it. Said invoice will include the concept and detail of the amounts received for the shipment of the requested orders.
2.10.- Transport and shipping costs.
Shipping and/or handling costs are not included in the price and will be shown to the customer before completing their purchase, depending on the shipping address of each order.
For orders over €50, shipping costs will be FREE. For all other situations, shipping costs include several flat rates:

If the customer does not notice external breakage in the package when receiving it, but upon opening it observes damage caused by transport, they must notify the transport company within 24 hours to record it and contact JUAN RAMON LOZANO, S.A.U. Otherwise, it will be understood that the product has been accepted in conformity. Once the aforementioned period has elapsed, the transport company considers that the shipped goods are in perfect condition and is not responsible for possible defects.
2.11.- Product delivery.
Products will be sent to the shipping address that the customer has indicated in the order. In the case of placing an order for several items with different availabilities, the shipping period will take into account the longest expected delivery. The courier does not make deliveries on Saturdays, Sundays, or holidays.
It is not possible to arrange delivery times. The delivery period will be 2 – 3 working days after placing the order for products available for immediate shipment and 3 – 7 working days for products not available for immediate shipment.
In exceptional cases, JUAN RAMON LOZANO, S.A.U reserves the right to split the order, sending available items and leaving items not available pending a second shipment. JUAN RAMON LOZANO, S.A.U will not send any product until its Administration Department has verified that payment has been made.
In the event that the customer detects any problem at the time of delivery of their order (damaged packaging, defective, missing, or damaged products), they must indicate it in writing on the carrier’s delivery note, and notify JUAN RAMON LOZANO, S.A.U through email info@bodegas-lozano.com within 24 hours following receipt of the order.
No return of damaged items will be accepted, nor claims for missing items, if it has not been communicated within the established period. All this without prejudice to the warranty right for products not conforming to the contract that assists every consumer, in accordance with current regulations.

3. ORDER EXCHANGE, CANCELLATION, AND RETURN.
3.1.- Exchange.
The customer may change an order if it has not yet been dispatched. For any change, they must notify us as soon as possible via email info@bodegas-lozano.com, indicating the desired changes.
These changes are not permitted by the customer when the product is made to measure, personalized, or following their instructions.
3.2.- Cancellation.
Orders may be canceled in whole or in part up to 72 hours before the agreed reception date. For any order cancellation, you must notify us as soon as possible via email info@bodegas-lozano.com
If the cancellation is made within the aforementioned period, no penalty will be applied to the customer. If the cancellation is made after the agreed 72-hour period prior to delivery, the customer may not cancel the order or, where applicable, must pay a surcharge for late cancellation in the amount of €7.94.
If an order is cancelled once it has already been confirmed and dispatched, the customer must bear the transport and processing costs incurred.
Cancellation of orders placed by the customer is not permitted when the product is made to measure, personalised, or produced according to the customer’s instructions.
As a result of a cancellation with the right to a refund, the purchase amount will be refunded using the same payment method used for the initial transaction, unless expressly agreed otherwise.
For credit cards, the amount will be refunded at the end of the monthly billing period. The exact refund date depends on the credit card agreement between the bank and the customer. Refunds by bank transfer will be made within the following seven business days or, where applicable, in accordance with the terms stipulated by the relevant bank.
Any difference in amount between the original order and the modified order will be processed in accordance with the procedure applicable to the chosen payment method. Return and reshipping costs will not be borne by JUAN RAMON LOZANO, S.A.U.
JUAN RAMON LOZANO, S.A.U may not substitute a product or product model without prior consultation with the customer. If, for reasons beyond JUAN RAMON LOZANO, S.A.U’s control, it is not possible to fulfil the order, the customer will be offered the option to replace it with a substitute product of similar characteristics, and the customer will be granted the right to cancel the order.
3.3.- Return of orders.
Orders may be returned within 14 days from the date of purchase, and for this, the Customer must contact JUAN RAMON LOZANO, S.A.U via email info@bodegas-lozano.com
Conditions for returns.

Once the goods have been received at our warehouses and it has been verified that the item meets the required return conditions, we will refund the purchase amount using the same payment method used.
3.4.- Cancellation of visits, experiences and tastings.
As a general rule, cancellations must be notified at least 48 hours before the scheduled date of the activity. Cancellations within this period incur no charges. If you cancel after this period or do not attend on the day of the activity, the winery will consider the visit as completed and the amount paid will not be refunded.
4.- RIGHT OF WITHDRAWAL.
The customer has the right to withdraw from the purchase within 14 calendar days without justification, for all orders that have not been custom-made or made according to the customer’s instructions. To do this, they must call (+34) 967 14 19 07.
The withdrawal period will expire 14 calendar days, starting from the day on which the customer or a third party indicated by them, other than the carrier, received the order.
4.1.- Products not subject to the right of withdrawal.
In the case of made-to-measure orders or orders made under the customer’s instructions, section c) of Article 103 of Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws, shall apply, which provides as follows:
“The right of withdrawal shall not apply to contracts relating to:
c) The supply of goods manufactured according to the consumer’s specifications or clearly personalized.”
Therefore, in the case of made-to-measure and/or personalised products according to the customer’s instructions, the customer may not exercise the right of withdrawal.
4.2.- How to exercise the right of withdrawal.
To exercise the right of withdrawal, you must send the withdrawal form, available in this section, to JUAN RAMON LOZANO, S.A.U by any of the following means:
To meet the withdrawal deadline, it is sufficient for the communication regarding your exercise of this right to be sent before the relevant period expires.
In the event of withdrawal, all payments received will be refunded. However, the customer must bear the direct cost of returning the goods.
Payment will be made without undue delay and, in any event, no later than 14 calendar days from the date on which the customer informs us of the withdrawal. The refund will be made using the same payment method used for the initial transaction, unless expressly agreed otherwise; in any case, the customer will not incur any fees as a result of the refund.
5.- WARRANTIES.
All products have a two-year warranty from the delivery date; however, it does not cover defects caused by negligence, impacts, improper use, or improper handling. In addition, the warranty will be void if the purchase invoice is not available.
Unless proven otherwise, any lack of conformity that becomes apparent within six months of delivery of the product shall be presumed to have existed at the time of delivery, except where this presumption is incompatible with the nature of the product or the nature of the lack of conformity.

6.- CUSTOMER RESPONSIBILITY.
The customer undertakes to make lawful use of the Services, without contravening applicable legislation or infringing the rights and interests of third parties.
The customer guarantees the truthfulness and accuracy of the data provided when completing the contracting forms, avoiding causing harm to JUAN RAMON LOZANO, S.A.U as a result of any inaccuracies.
They also undertake to enable delivery of the requested order by providing a delivery address where the requested order can be received during normal goods delivery hours (Monday to Friday from 10:00 to 13:30 and from 16:00 to 19:00).

If any clause included in these Specific Terms and Conditions of Contracting is declared, in whole or in part, null and void or ineffective, such nullity or ineffectiveness shall affect only that provision or the part thereof that is null and void or ineffective, and the remaining General Terms and Conditions of Purchase shall remain in force. Consequently, the clause declared wholly or partially null and void or ineffective shall be deemed not to have been included.
12.- APPLICABLE LAW AND SUBMISSION TO JURISDICTION.
Sales made by the Company are subject to Spanish law.
In the event that any conflict or discrepancy arises in the interpretation or application of these contractual conditions, JUAN RAMON LOZANO, S.A.U submits to the consumer arbitration system / to the Courts and Tribunals that, where applicable, shall have jurisdiction over the matter, and which shall be those provided by the applicable legal regulations on competent jurisdiction: in the case of final consumers, the place of fulfillment of the obligation or the domicile of the purchasing party.

Withdrawal Conditions.
In accordance with Royal Legislative Decree 1/2007 of 16 November, the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws, JUAN RAMON LOZANO, S.A.U makes available to buyers the right to withdraw from the purchase made within 14 calendar days from receipt of the product, without the need to provide any reason and without incurring additional costs, except as provided for extraordinary costs beyond the basic shipping established in the accepted General Terms and Conditions of Purchase, or for deterioration due to handling of the product for which the buyer is responsible.

The right of withdrawal shall not apply to:
Refund of the purchase amount.
Once the returned product has been received and it has been verified that the product is in suitable condition and with no deterioration other than that caused by transport and the buyer’s opening of the product, JUAN RAMON LOZANO, S.A.U will proceed to refund the purchase amount.
Damage other than that indicated above shall be borne by the buyer.
