JUAN RAMON LOZANO, S.A.U, through these General Purchase Terms and Conditions, offers its users and visitors the possibility of making online purchases of the products and services offered, as well as establishing communication with the user.

JUAN RAMON LOZANO, S.A.U will carry out its e-commerce activity as a virtual store through the website http://www.bodegas-lozano.com/.

JUAN RAMON LOZANO, S.A.U may, at any time and without prior notice, alter the design, presentation, and/or configuration of the Website, as well as some or all of the services.

1.3.- Acceptance of the specific purchase conditions.

Access and use of the service of http://www.bodegas-lozano.com/ imply the User’s full and unreserved acceptance of all conditions contained in these General Purchase Terms and Conditions. Likewise, JUAN RAMON LOZANO, S.A.U reserves the unilateral right to modify these General Terms and Conditions at any time.

Any order placed with JUAN RAMON LOZANO, S.A.U necessarily implies, as an essential, determining, and indispensable condition, the unreserved acceptance by the customer of the General Purchase Terms and Conditions of its products, in force on the day the corresponding order is placed. Furthermore, the customer acknowledges that the acceptance of these General Purchase Terms and Conditions will imply their application to the order to which they refer, as well as to all subsequent orders, with the exception of those cases in which new conditions are brought to their attention by JUAN RAMON LOZANO, S.A.U.

The fact that JUAN RAMON LOZANO, S.A.U does not, at any given moment, resort to any of these conditions cannot be interpreted as, nor will it amount to, a waiver of the right to resort to them in the past or the future.

2.- ONLINE PURCHASE PROCESS.

2.1.- Our products, how to find them?

In addition to having physical stores, JUAN RAMON LOZANO, S.A.U offers you a virtual store that provides all kinds of products and services organized into categories, to make them easier to find.

From the home page, you can access all levels of product categories. You can also find products at JUAN RAMON LOZANO, S.A.U through the search engine, where you only need to enter a keyword (which can be the product name, characteristics, or even incomplete words) and click the search button.

2.2.- Product categories/families:

All products have a detailed description, which includes a photograph, name, description, and price with taxes included. The prices shown on the product descriptions constitute an invitation for the customer to make an order proposal; therefore, if there is an error in them, JUAN RAMON LOZANO, S.A.U will inform the customer of such circumstance and will not process the order.

Once the products are selected, they will be added to the Shopping Cart, where the user can add or remove products at any time. Once the product selection process is complete, or directly by clicking the “BUY” button, the visitor can finalize the product selection process and proceed to payment.

2.4. Product availability.

The selection of products offered through JUAN RAMON LOZANO, S.A.U is valid as long as the products are visible on the Website. As this is e-commerce, stock is updated online, so it could eventually happen that during the purchase process, stock runs out, making it impossible to    continue with the initiated sale.

The availability status of each product is indicated on its product page:

  • In stock, dispatch within 24 / 72 hours. The item is in our stock, and our commitment for dispatch from our warehouse is within 24 / 72 hours.
  • Check stock. If stock is not available, delivery is subject to the production date of the item for it to be served, and the customer will be informed of the order’s availability within 24/48 hours.
  • Out of stock. Item out of stock and temporarily unavailable for purchase.

To these availability periods, the time it takes for our transport operator [include carrier name] to deliver the goods must be added. These periods are calculated on business days (Monday to Friday, inclusive) since JUAN RAMON LOZANO, S.A.U does not make shipments on holidays, Saturdays, or Sundays.

The indicated dispatch times are approximate. In the event of a stockout or temporary unavailability of an item, JUAN RAMON LOZANO, S.A.U will contact the customer immediately to inform them and provide a new delivery period or, if it is not possible to supply said product, proceed with its cancellation.

In any case, a delay in delivery beyond the indicated deadlines will not entitle the customer to claim any compensation.

2.5.- How is the order processed?

The purchase of products must be made by activating the “BUY” button that appears at the bottom of the purchase request, and expresses full acceptance of each and every one of these Purchase Terms and Conditions, as shown on http://www.bodegas-lozano.com/, prior to the acquisition of the products.

When clicking the process order button (after selecting the products and quantities), the registered user must enter their username and password, directly accessing a personalized purchase panel, where they can modify their shipping address details and select different shipping types and payment methods; in the case of a guest purchase, personal data will be requested for order processing and delivery.

2.6.- Prices.

The prices applicable to each product, which include VAT, are those indicated on the product page. During the purchase process, the amount corresponding to the tax burden according to the current rate at all times and applicable to the marketed products and/or services, as well as the corresponding shipping costs, will be itemized before order confirmation.

Offers will be duly marked and identified as such, conveniently indicating the previous price and the offer price.

JUAN RAMON LOZANO, S.A.U reserves the right to make, at any time and without prior notice, any modifications it deems appropriate, being able to update products and services daily according to the market.

The corresponding shipping costs are always indicated in the order.

For shipments to countries outside the European Union, JUAN RAMON LOZANO, S.A.U will not assume the costs corresponding to customs duties and taxes specific to each country.

In case of a price variation, JUAN RAMON LOZANO, S.A.U will notify the customer by email of the variation, and the customer may choose to cancel their order without incurring any additional cost.

2.7.- Payment methods.

JUAN RAMON LOZANO, S.A.U offers various payment methods so that the customer can choose the one that best suits their needs:

  • Payment by Visa, MasterCard, and American Express Credit Card, which have developed a secure system for online payments. The Secure Electronic Commerce system is based on the card Issuer identifying the cardholder before authorizing the online payment. JUAN RAMON LOZANO, S.A.U reserves the right to reject any operation carried out with a credit card. In this case, we will refund the amount to the original card. In such cases, and if the customer is interested in proceeding with the purchase of the items, we will request a bank transfer.

If this is the method selected by the user for payment, a secure connection is established, via SSL[1], where you must confirm the payment and enter your bank details directly. This page is not controlled by JUAN RAMON LOZANO, S.A.U, but is an external payment gateway, so JUAN RAMON LOZANO, S.A.U does not have access to your bank details nor does it store them.

  • Payment by Bank Transfer: You can make a bank transfer to the account that will be indicated to you when you select this payment method. The order will not be considered effective until we confirm the corresponding deposit.

Delivery times begin from this date. To process the order as soon as possible, it is necessary that the order number is reflected in the transfer concept. The Company will not be responsible for delays caused by this reason.

  • PayPal Account: A secure payment system in which the user opens an account that subsequently allows them to make payments in many online stores around the world, using their credit or debit card. PayPal will be the only one with access to the customer’s bank details, acting as an intermediary between the customer and JUAN RAMON LOZANO, S.A.U. When the customer makes the payment, it is immediate. In this way, JUAN RAMON LOZANO, S.A.U receives it and proceeds to process their order (after verifying that the data is correct). To register or obtain more information, visit www.paypal.es, PayPal’s site for Spain. These links are external and lead to pages with their own terms of use and/or privacy.
  • Cash on Delivery: Shipments are made through Correos de España. This payment method cannot be used for amounts exceeding €50 or for orders placed from the Canary Islands, Ceuta, and Melilla.

To make the payment using this method, there are two options to choose from:

  • Correos cash on delivery, by which the order will arrive within three to five business days. The postman will leave you a notice to pick up your order at the corresponding branch and pay there. Shipping costs for this option will be €7.94.

·         Albeso, by which the order will arrive in 24 /48 h. The transport service will deliver the shipment to the provided address, where you will pay the amount to the delivery person. For this, it will be essential that you provide us with your contact phone number. Shipping costs for this option (up to 10 kg. in weight) will be €7.94.

Specific conditions for this payment system. If the cash on delivery payment method is chosen, in addition to the product price, the aforementioned surcharge of €7.94 must be paid, as a transport tax.

2.8.- Non-payment.

Upon the agreed due date for shipment, in case of total or partial non-payment by the customer, JUAN RAMON LOZANO, S.A.U may suspend or cancel any shipment, without incurring liability for any damages or losses, including loss of profit, or damages for delay or loss of production caused to the customer. The aforementioned right of JUAN RAMON LOZANO, S.A.U shall in no case release the customer from their contractual obligations regarding outstanding payments and the receipt of products.

2.9.- Invoicing.

JUAN RAMON LOZANO, S.A.U will be obliged to issue an invoice to customers who request it. Said invoice will include the concept and details of the sums received for the shipment of the requested orders.

2.10.- Transport and shipping costs.

Shipping and/or handling costs are not included in the price and will be shown to the customer before finalizing their purchase, depending on the shipping address of each order.

For orders over €50, shipping costs will be free. For other situations, shipping costs include several types of flat rates:

  1. €7.94 for general shipping costs.
  2. €7.94 for island shipping costs.
  3. €7.94 in costs, which will be applied as a surcharge when the customer chooses cash on delivery as the payment method.

JUAN RAMON LOZANO, S.A.U is not responsible for any delay in transport caused by:

  1. Incorrect or incomplete address
  2. Failure to provide a contact phone number
  3. Carrier strikes and force majeure situations.

If the customer does not notice external damage to the package upon receipt, but upon opening it observes damage due to transport, they must notify the transport company within 24 hours to record it and contact JUAN RAMON LOZANO, S.A.U. Otherwise, it will be understood that the product has been accepted in conformity. Once the aforementioned period has elapsed, the transport company considers that the goods shipped are in perfect condition and is not responsible for possible defects.

2.11.- Delivery of products.

Products will be sent to the shipping address indicated by the customer in the order. In the case of ordering several items with different availabilities, the dispatch period will take into account the longest expected delivery. Couriers do not make deliveries on Saturdays, Sundays, or holidays.

It is not possible to agree on delivery times. The delivery time will be 2 – 3 business days after placing the order for products available for immediate shipment and 3 – 7 business days for products not available for immediate shipment.

In exceptional cases, JUAN RAMON LOZANO, S.A.U reserves the right to split the order, sending available items and holding non-available items for a second shipment. JUAN RAMON LOZANO, S.A.U will not ship any product until its Administration Department has verified that payment has been made.

Should the customer detect any problem at the time of delivery of their order (damaged packaging, defective, missing, or deteriorated products), they must indicate it in writing on the carrier’s delivery note and notify JUAN RAMON LOZANO, S.A.U via email info@bodegas-lozano.com within 24 hours of receiving the order.

No returns of damaged items will be accepted, nor claims for missing items, if not communicated within the established period. All this is without prejudice to the right of guarantee for products not conforming to the contract that all consumers are entitled to, in accordance with current regulations.

3. ORDER CHANGE, CANCELLATION, AND RETURN.

3.1.- Change.

The customer may change an order if it has not yet been dispatched. For any change, they must notify us as soon as possible via email  info@bodegas-lozano.com, indicating the desired changes.

Such changes by the customer are not permitted when the product is custom-made, personalized, or made according to their instructions.

3.2.- Cancellation.

Orders may be canceled in whole or in part up to 72 hours before the agreed reception date. For any order cancellation, you must notify us as soon as possible via email  info@bodegas-lozano.com

If the cancellation is made within the mentioned period, no penalty will be applied to the customer. If the cancellation is made after the agreed 72 hours for reception, the customer will not be able to cancel their order, or, if applicable, must pay a surcharge as a consequence of a late cancellation, for an amount of €7.94.

In case of canceling an order once it has been confirmed and shipped, the customer must bear the transport and processing costs incurred.

Cancellation of orders placed by the customer is not permitted when the product is custom-made, personalized, or made according to their instructions.

As a result of a cancellation with the right to a refund, the purchase amount will be refunded using the same payment method used for the initial transaction, unless expressly agreed otherwise.

For credit cards, the amount will be refunded at the end of the monthly billing period. The exact date of the refund depends on the credit card agreement between the bank and the customer. The refund via bank transfer will be made within the following seven business days, or, if applicable, in accordance with what is stipulated by the corresponding bank.

Any difference in amount between the original and modified order will be processed following the procedure corresponding to the chosen payment method. Return and re-shipping costs will not be borne by JUAN RAMON LOZANO, S.A.U.

For its part, JUAN RAMON LOZANO, S.A.U may not substitute a product or product model without prior consultation with the customer. If it happens that, for reasons beyond JUAN RAMON LOZANO, S.A.U’s control, the supply of the order is not possible, the customer will be offered the possibility of exchanging it for a substitute product of similar characteristics, granting the right to cancel the order by the customer.

3.3.- Order returns.

Orders may be returned within 14 days from the date of purchase, and for this, the Customer must contact JUAN RAMON LOZANO, S.A.U via email info@bodegas-lozano.com

Conditions for return.

  • Returns of orders placed by the customer are not permitted when the product is custom-made, personalized, or made according to their instructions.
  • The product must not have been used and must be returned in the same original packaging in which it was received, as well as with the original labels and stickers. Products that have been modified cannot be returned.
  • The customer must have the purchase invoice. If not, it must be recorded in the JUAN RAMON LOZANO, S.A.U database.
  • The customer must bear the shipping costs in case of return, which must be paid directly to the transport company at the time of collection. No material received freight collect will be picked up.
  • The item to be returned must be properly packaged for its return.
  • The shipping costs of the order will not be refunded.

Reasons for product returns will be:

  1. That the product does not meet the characteristics of the description shown on our website. In this case, the product amount will be refunded, excluding shipping costs. This refund will be made to the payment method used by the customer.
  2. That the product is originally defective. In this case, it will be exchanged for an identical one once the product to be returned has been received. JUAN RAMON LOZANO, S.A.U will cover the return and re-shipping costs.

Once the merchandise is received at our warehouses and verified that the item meets the required return conditions, we will proceed to integrate the purchase amount using the same payment method that was used.

4.- RIGHT OF WITHDRAWAL.

The customer has the right to withdraw from the purchase within 14 calendar days without justification, for all orders that have not been custom-made or made according to the customer’s instructions. To do this, they must complete the following form or call (+34) 967 14 19 07:

The withdrawal period will expire 14 calendar days, starting from the day on which the customer or a third party indicated by them, other than the carrier, received the order.

4.1.- Products not subject to the right of withdrawal.

In cases of custom-made orders or orders made according to the customer’s instructions, section c) of article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the Revised Text of the General Law for the Defense of Consumers and Users and other complementary laws, will apply, which states the following:

“The right of withdrawal shall not apply to contracts relating to:

c) The supply of goods manufactured according to the consumer’s specifications or clearly personalized.” 

Consequently, in the case of custom-made products and/or products personalized according to the customer’s instructions, the customer may not exercise the right of withdrawal.

4.2.- How to exercise the right of withdrawal.

To exercise the right of withdrawal, you must send the withdrawal form, accessible in this section, to JUAN RAMON LOZANO, S.A.U by any of the following means:

To meet the withdrawal deadline, it is sufficient for your communication concerning the exercise of the right to be sent before the corresponding period expires.

In case of withdrawal, all payments received will be refunded to you. However, the customer must bear the direct cost of returning the goods.

Payment will be made without undue delay and, in any case, within a maximum of 14 calendar days from the date on which the customer informs of the withdrawal. Said refund will be made using the same payment method used for the initial transaction, unless expressly agreed otherwise; in any case, the customer will not incur any expense as a result of the refund.

5.- GUARANTEES.

All products have a two-year warranty from the date of delivery, although this does not include deficiencies caused by negligence, blows, incorrect use, or improper handling. Furthermore, the warranty will lose its value if there is no purchase invoice.

Unless proven otherwise, any lack of conformity that becomes apparent within six months after delivery of the product shall be presumed to have existed when the product was delivered, except when this presumption is incompatible with the nature of the product or the nature of the lack of conformity.

The warranty will be invalid under the following circumstances:

  • Blows and/or inadequate transport,
  • Fault or negligence of the customer or a third party,
  • Incorrect use,
  • Damage as a result of force majeure.

6.- CUSTOMER RESPONSIBILITY.

The customer undertakes to make lawful use of the Services, without contravening current legislation, or harming the rights and interests of third parties.

The customer guarantees the veracity and accuracy of the data provided when completing the contracting forms, avoiding causing damage to JUAN RAMON LOZANO, S.A.U as a consequence of their inaccuracy.

Likewise, they undertake to enable the delivery of the requested order by providing a delivery address where the requested order can be received within the usual delivery hours for goods (Monday to Friday from 10:00 AM to 1:30 PM and from 4:00 PM to 7:00 PM).

Failure to comply with any of these General Contract Conditions may lead to the annulment or cancellation of orders by JUAN RAMON LOZANO, S.A.U without prior notice to the customer and without this implying any right to compensation.

If the shipment is rejected by the customer, JUAN RAMON LOZANO, S.A.U will not refund the shipping costs, which will be borne by the customer.

9.- INDUSTRIAL AND INTELLECTUAL PROPERTY

The intellectual and industrial property rights over the works, trademarks, logos, and any other protectable content contained on the website belong exclusively to JUAN RAMON LOZANO, S.A.U, unless different ownership is indicated therein.

The unauthorized reproduction, distribution, commercialization, or transformation of such works, trademarks, logos, etc. constitutes an infringement of the intellectual and industrial property rights of JUAN RAMON LOZANO, S.A.U or their owner, and may give rise to the exercise of any judicial or extrajudicial actions that may correspond to them in the exercise of their rights.

Likewise, the information to which the customer may access through the website may be protected by industrial, intellectual, or other property rights. The Company shall not be liable in any case and under any circumstances for infringements of such rights that you may commit as a user and/or customer.

10.- NOTIFICATIONS.

All notifications, requirements, requests, and other communications that must be made by the parties in relation to these General Terms and Conditions of Purchase must be made in writing and shall be deemed to have been duly sent by ordinary mail to the address of the other party or their email address.

Specifically in the case of JUAN RAMON LOZANO, S.A.U, notification must be sent to the postal address: Avda. Reyes Católicos, 156 Villarrobledo, 02600 ALBACETE, at the telephone number (+34) 967 14 19 07 or at the email address  info@bodegas-lozano.com.

11.- NULLITY AND INEFFECTIVENESS OF CLAUSES.

If any clause included in these Particular Conditions of Contracting were declared, totally or partially, null or ineffective, such nullity or ineffectiveness shall affect only that provision or the part thereof that is null or ineffective, with the rest of the General Conditions of Purchase remaining in force. Consequently, the clause declared totally or partially null or ineffective shall be deemed not to have been included.

12.- APPLICABLE LAW AND SUBMISSION TO JURISDICTION.

Sales made through the Company are subject to Spanish law.

In the event that any conflict or discrepancy arises in the interpretation or application of these contractual conditions, JUAN RAMON LOZANO, S.A.U submits to the consumer arbitration system / to the Courts and Tribunals that, where applicable, shall have jurisdiction over the matter, and which shall be those provided by the applicable legal regulations on competent jurisdiction: in the case of final consumers, the place of fulfillment of the obligation or the domicile of the purchasing party.

In the event that the purchasing party acts on behalf of a legal entity, both parties submit, with express waiver of any other jurisdiction, to the Courts and Tribunals of Albacete.

Withdrawal Conditions.

In accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, Revised Text of the General Law for the Defense of Consumers and Users and other complementary laws, JUAN RAMON LOZANO, S.A.U makes available to purchasers their right to exercise withdrawal from the purchase made, within 14 calendar days from receipt of the product, without the need to give any reason and without incurring additional costs, except as provided for extraordinary expenses outside the basic shipping established in the General Conditions of Purchase accepted or for deterioration in the handling of the product for which the purchaser is responsible.

Once the purchaser has notified JUAN RAMON LOZANO, S.A.U of the withdrawal, the purchaser must proceed to return the purchased items/products as soon as possible and, in any case, within a maximum period of 20 calendar days from notification of withdrawal.

The right of withdrawal shall not apply to:

  1. The supply of goods made to the consumer and user’s specifications or clearly personalized.
  2. The supply of goods that may deteriorate or expire rapidly.
  3. The supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery.

Refund of purchase amount.

Once the return of the product has been received and it has been verified that the product is in adequate condition and without more deterioration than that of transport itself and opening of the product by the purchaser, JUAN RAMON LOZANO, S.A.U will proceed to refund the purchase amount.

Damage produced beyond those previously indicated shall be charged to the purchaser.
